What if I want to relocate out of the county or state?

In Texas, the court has the authority to restrict a custodial parent from moving to a new state or moving to a location of significant distance that may affect the visitation rights of the non-custodial parent. A custodial parent who wishes to move to a new location must obtain the agreement of the non-custodial parent or permission from the court. We can help advise you about the types of situations that may justify a relocation. We can explain and take you through the process which may include the preparation of a social study. The social study will demonstrate to the court whether relocation would be in the child’s best interest.
